1. What Colibrí is
Colibrí is a technology platform that connects people who buy, businesses that sell, wholesalers that distribute and drivers that deliver. Colibrí does not sell products, prepare food or make deliveries itself.
Drivers, businesses and wholesalers are independent users of the platform. There is no labor or corporate relationship with Colibrí: each one decides when to use the platform, which orders to accept and at what price, with no schedule or exclusivity.
2. Accounts
To order or deliver you sign in with a phone number and a verification code. Businesses and wholesalers sign in with email and password. You are responsible for the activity on your account and for keeping your details up to date.
Wholesaler accounts are activated after reviewing the request, the owner's identity and the company's documents. Colibrí may pause or close an account that breaches these terms.
3. Orders and delivery price
The customer proposes the delivery price within the range in force in their country. Nearby drivers can accept it or counteroffer, and the customer chooses. If nobody accepts, the platform may raise the offer automatically, according to the current configuration, before cancelling.
The price of each product is set by the business or wholesaler that sells it. Colibrí charges no commission on product prices or on the agreed delivery price.
4. Payments and prepaid packages
Payments are processed in USD through the payment processor enabled in the country. The product amount is settled to the business or wholesaler and the delivery amount to the driver.
The customer can pay by card or in cash on delivery. To accept cash orders, the driver keeps a security deposit with the minimum balance in force.
Businesses, wholesalers and drivers buy prepaid packages of sales or deliveries. Each completed sale or delivery deducts one unit from the package. Packages do not expire and their price is shown before buying.
5. Claims and refunds
If an order arrives incomplete or incorrect, the customer can file a claim from the order within 24 hours of delivery. Colibrí reviews the claim and, where appropriate, refunds the corresponding amount.
Cancellations after payment, late dispatches and damaged or wrong products are recorded as faults of the responsible business or wholesaler, who can dispute each record.
6. Security deposits
Drivers and wholesalers keep a security deposit that backs their deliveries and dispatches. If the balance falls below the minimum in force, the account pauses until it is topped up. The deposit is returned when the account is closed, minus recorded faults.
7. Acceptable use
Selling prohibited or regulated products without the corresponding license, impersonating another person, manipulating delivery offers or using the platform for unlawful purposes is not allowed.
8. Liability
Colibrí provides the platform as is. Product quality is the responsibility of whoever sells it, and the delivery, of the driver who accepts it. Colibrí is liable for the operation of the platform under the terms set by applicable law.
9. Governing law
These terms are governed by the laws of the Republic of El Salvador. Any dispute is submitted to the competent courts of San Salvador.
10. Changes and contact
Colibrí may update these terms. The current version is the one published on this page. Write to us at hola@viacolibri.com.
